The Mayor called the meeting to order at 7:32 p.m. with the playing of O'Canada.

CECIL ROY, KOREAN VETERANS ASSOCIATION
Mayor Crosby welcomed Mr. Cecil Roy, Korean Veterans Association.
Mr. Cecil Roy expressed his thanks and appreciation to the Town of Yarmouth for their donation of land and money for the Korean Veterans Memorial at the corner of Parade and Pleasant Street. He also thanked the people of Yarmouth for helping the Association raise funds for the memorial and extended thanks to the Sweeney family who gave the land to the Town of Yarmouth.
Councillor Judge thanked Mr. Roy for his part in the Korean Veterans memorial.
Mayor Crosby, on behalf of Council and the citizens of Yarmouth, thanked Mr. Roy for his efforts and the efforts of the community.
CORRESPONDENCE FOR ACTION
Correspondence from Steve Chapman, Canadian Environmental Assessment Agency, welcoming comments regarding a draft agreement on the environmental assessment panel review process for the proposed Whites Point Quarry and Marine Terminal in Digby County, was considered.
MOVED BY Deputy Mayor Hood, SECONDED BY Councillor Strickland the correspondence from the Canadian Environmental Assessment Agency be placed on file for future reference.

A recommendation from the CAO regarding the purchase of a 4 X 4 extended cab compact pickup from Motor Mart Ltd, in the amount of $25,000 plus HST, lowest of three bids, was considered.

Direction was requested regarding the Hubert Brush Centre.

Direction was requested regarding property recently acquired by the Town from Danny MacIsaac in the South End.

Direction was requested regarding an additional property being acquired by the Town in the South End.

A request to install a street light on Placid Court was considered.
MOVED BY Councillor Strickland, SECONDED BY Councillor Dares that staff be authorized to proceed with the installation of a street light on Placid Court.

A request to install a street light on Cottage Lane was considered.
MOVED BY Deputy Mayor Hood, SECONDED BY Councillor Strickland to defer the request for the installation of a street light on Cottage Lane to the next Council meeting.

PLANNING ADVISORY COMMITTEE
Councillor Judge brought forward the following recommendations from the Planning Advisory Committee and Public Hearing:
MOVED BY Councillor Judge, SECONDED BY Councillor Dares, to amend the Municipal Planing Strategy and Land Use By-law to regulate outdoor furnaces through the Land Use By-law as outlined in the Planer's report. (Appendix A)
MOVED BY Councillor Judge, SECONDED BY Councillor Strickland to amend the Municipal Planning Strategy, in particular Policy 2.2.14 to enable General Commercial ( C - 2 ) zoned properties to be rezoned to Medium Density Residential ( R - 2 ) as outlined in the Planner's report. (Appendix B)

WATER UTILITY
Deputy Mayor Hood advised the treatment plant has been up and running for about three months and a tour of the facility was being organized.
LEISURE SERVICES
Councillor Boudreau advised the Leisure Services Committee met on Wednesday, September 3. He advised that Vincent Forrestall had replaced Danielle Amirault as Community and Recreation Developer.
Councillor Boudreau expressed the concern of the Committee relating to the lighting at Veterans Field. He advised the Committee was looking at taking out the lights due to the cost of replacements throughout the winter. Concerns were also expressed regarding the height of the lights and they hoped to phase in larger poles to ratify this problem.
Councillor Boudreau advised the Milo Boat Club has been very successful this season.
OCCUPATIONAL HEALTH AND SAFETY
Councillor Boudreau advised the Occupational Health and Safety Committee met on Wednesday, September 3, 2003. He advised the Committee reviewed a safety hazard at the Landfill which has now been rectified. The next meeting is December 3, 2003.
HEATING FUEL REBATE
Councillor Strickland raised concerns regarding the cost or heating fuel.
MOVED BY Councillor Strickland, SECONDED BY Councillor Judge that Council request the provincial government implement a program which increases the current rebate from $50 to $100 to those who qualify.

WATERFRONT DEVELOPMENT CORPORATION
Deputy Mayor Hood advised that due to the high tender for the next phase of the Waterfront Development project the Committee would be looking at options at their next meeting. He advised the Committee would like to remain within the perimeter of the original plan.
MARINERS CENTRE
Deputy Mayor Hood referred to correspondence received from Mariners Centre regarding the roadway between the Zamboni Room and the Anthony Pavilion.
MOVED BY Deputy Mayor Hood, SECONDED BY Councillor Boudreau the correspondence from Mariners Centre regarding a roadway between the Zamboni Room and the Anthony Pavilion be referred to the Finance Committee.

PORT OF YARMOUTH
Mayor Crosby advised the Port of Yarmouth is working on arrangements to attend a meeting in the United States regarding the security issue.
STAFF REPORTS
VETERANS STATUS
Councillor Dares brought forward a request from Ken Kelly, Fire Chief, requesting Veterans Status for Adele Robicheau and Millie Jacobson.
MOVED BY Councillor Dares, SECONDED BY Councillor Boudreau that Veterans Status be granted to Adele Robicheau and Millie Jacobson.

Mayor Crosby thanked the Yarmouth Fire Department for their actions and the numerous services they provide to the communities.
CONGRATULATIONS/JOEY SURETTE
Mayor Crosby introduced Joey Surette and congratulated him for his achievements. Mr. Surette displayed his medals to Council and the public.
