BUSINESS ARISING

CANADIAN CHARITABLE ORGANIZATIONS

MOVED BY Councillor Pink, SECONDED BY Councillor Dares that Council approve the Second Reading of the Canadian Charitable Organizations By-law (no. 27). (Appendix A)

Mayor Crosby invited Mr. Ed Ratee, Lyons Club, to speak on the proposed By-law. There were no other verbal nor written comments.

Mayor Crosby thanked Mr. Ratee his presentation.

TAXI BY-LAW

MOVED BY Councillor Hood, SECONDED BY Councillor Pink that Council approve the Second Reading of the Taxi By-law (No. 32). (Appendix B)

Mayor Crosby then invited the public to speak on the proposed By-law. There were no verbal nor written comments.

CORRESPONDENCE FOR ACTION

UNSM - PROPOSED AMENDMENT TO MGA

Correspondence from Councillor Jerry Blumenthal, President, UNSM regrading the proposed amendment to the MGA was considered.

MOVED BY Councillor Pink, SECONDED BY Councillor Dares that Council support the position of the Table Officers which opposes the proposed amendment to the Municipal Government Act (MGA) and also that the UNSM seek an alternate solution.

FIRE VEHICLES & THE USE OF RESTRICTED LICENSE PLATES

Mayor Crosby advised there would be no change to the licencing of fire vehicles and use of restricted licence plates.

RESOLUTIONS COMMITTEE

Mayor Crosby, as Chair of the Resolutions Committee, invited Deputy Mayor Hood to sit on the Committee. Deputy Mayor Hood accepted.

FIDELIS HOUSE RE: FINANCIAL ASSISTANCE

Correspondence from the Fidelis House Society, requesting financial assistance, was considered.

MOVED BY Councillor Dares, SECONDED BY Councillor Pink that the request from Fidelis House Society be referred to the Finance Committee.

YARMOUTH COUNTY MUSEUM

Correspondence from Mary Eldridge on behalf of the Yarmouth County Museum and Historical Research Library, requesting Council to hold a Public Hearing regarding the proposed expansion to the Yarmouth County Museum prior to the end of May, was considered.

MOVED BY Councillor Dares, SECONDED BY Councillor Boudreau that Council hold a Public Hearing, as soon as legally possible, for the application for an addition greater than five hundred (500) square feet to the Yarmouth County Museum Located at 22 Collins Street within the Collins Heritage Conservation District.

MOVED BY Councillor Dares, SECONDED BY Councillor Pink to amend this motion to include "it would be appropriate to have a Public Hearing prior to the Finance Committee meeting on May 27, 2002 at 7:00 p.m."

The main motion to read: "...that Council hold a Public Hearing for the application for an addition greater than five hundred (500) square feet to the Yarmouth County Museum Located at 22 Collins Street within the Collins Heritage Conservation District prior to the Finance Committee meeting on May 27, 2002, at 7:00 p.m."

SERVICE NOVA SCOTIA & MUNICIPAL RELATIONS

Correspondence from David Darrow, Executive Director, Service Nova Scotia & Municipal Relations, regarding Municipal InNOVA Award, was considered.

The CAO advised this was a new program announced by the Province this year and he would discuss a joint project with the CAO of the Municipality of the District of Yarmouth He advised he would bring information to Council at a future meeting.

MOVED BY Councillor Pink, SECONDED BY Councillor Dares that correspondence from Service Nova Scotia & Municipal Relations regarding the Municipal InNOVA Award, be referred to the CAO for action.

NOVA SCOTIA COMMUNITY COLLEGE

THE ATLANTIC CANADIAN OIL & GAS PRIMER

Councillor Boudreau advised Council he wished to attend a workshop regarding the oil and gas industry scheduled for June 3, 2002 at the Nova Scotia Community College, Burridge Campus. The course fee is $250.00 + HST.

MOVED BY Councillor Pink, SECONDED BY Councillor Dares that Councillor Boudreau be authorized to attend the Atlantic Canadian Oil & Gas Primer workshop.

CHILD CARE AWARENESS DAYS

Correspondence from Child Care Connection - NS, requesting the Town of Yarmouth declare the month of June, 2002 as Child Care Awareness Days and host a reception for child care practitioners in the community, or have council members attend the celebration events planned in the community during Child Care Awareness Days 2002.

MOVED BY Councillor Pink, SECONDED BY Councillor Dares that Council proclaim the month of June as Child Care Awareness Days 2002.

Editor's Note: The Mayor announced he would be pleased to take part in any events planned in the community during Child Care Awareness Days 2002.

CNIB - REQUEST FOR FINANCIAL ASSISTANCE

Correspondence from Dennis McCormack, Coordinator of Fundraising for the CNIB, requesting financial assistance, was considered.

MOVED BY Councillor Dares, SECONDED BY Councillor Pink the request from the CNIB for financial assistance be referred to the Finance Committee.

CORRESPONDENCE FOR INFORMATION

TREE PLANTING CEREMONY

Information regarding a Tree Planting Ceremony in recognition of the 75th Anniversary of the Old Age Pension in Canada was previously circulated. The ceremony is scheduled to take place on May 3, 2002 at noon.

TOURISM & CULTURE HERITAGE DIVISION

Information regarding the Heritage Property Program of the Department of Tourism and Culture was previously circulated.

Councillor Dares expressed concern that the Heritage budget had been cut in half.

MOVED BY Councillor Dares, SECONDED BY Councillor Pink that a letter be written to Premier Hamm advising that Council is disappointed the Province is not supporting Heritage Development with the budget. A copy of this letter is also to be forwarded to Rodney MacDonald, Wade Brown, our MLA Richard Hurlburt, and the Minister of Finance Neil LeBlanc.

STANDING COMMITTEES

FINANCE COMMITTEE

Councillor Pink advised a Finance Committee meeting has been scheduled for May 27, 2002.

PLANNING ADVISORY COMMITTEE

Councillor Boudreau read the following recommendation from the Planning Advisory Committee meeting of April 29, 2002.

MOVED BY Councillor Boudreau, SECONDED BY Councillor Dares, to advertise for a public hearing in order to consider and if deemed advisable, amend the Land Use By-law, in particular the Zoning Map, Schedule "A", thereby rezoning 332 and 344 Pleasant Street from Low Density Residential (R-1) to Medium Density Residential (R-2) as per planning report No. 66560-35-06 (2002-06).

YARMOUTH WATER UTILITY

Deputy Mayor Hood commented on the recent activities of the Water Utility including flushing of the water mains. He also advised the tender is closing for Phase II of the construction of the Water Treatment Plant on May 17, 2002.

He reported the Committee accepted recommendations provided in the Report for the Watershed Protection Strategy and Management Plan for Lake George, in principal and recommended that a set of regulations be drafted for consideration by Council at the June 13, 2002 meeting.

MOVED BY Deputy Mayor Hood, SECONDED BY Councillor Pink that the recommendation of the Committee, be accepted and re-distributed with the Final Report for consideration at the June 13, 2002 meeting.

JOINT LEISURE SERVICES COMMITTEE

Councillor Dares provided Council with an update on the Meadowfields Soccer field. She advised the School Board was refusing to sign the and a meeting was being planned to resolve their concerns.

IT WAS AGREED that Councillors Dare and Boudreau would check into the situation and advise Council of their findings.

OTHER COMMITTEES

JOINT EMERGENCY MEASURES

Councillor Boudreau advised the EMO building addition was up and work was progressing on the inside of the building. He also advised Council that National Emergency Preparedness Week was May 6 - 12, 2002. The next meeting is scheduled for June 15, 2002.

JOINT HOMECARE ADVISORY COMMITTEE

Mayor Crosby, as Chair of the Yarmouth Argyle Home Care, advised the first union contract between the Yarmouth Argyle Home Care and the NSGEU had been signed, and conveyed his thanks to the Deputy Mayor for his legal advice during the negotiations.

STAFF

LIEUTENANT GOVERNOR'S VISIT

The CAO advised Council of the Lieutenant Governor's Visit to Yarmouth scheduled for July 11, 2002.

APPROVAL OF INVOICES

MOVED BY Councillor Pink, SECONDED BY Councillor Dares that invoices, as approved by the individual chairs, be authorized for payment.
