A meeting of the Town Council of the Town of Yarmouth was held on Thursday, March 13, 2003.

CALL TO ORDER

The Mayor called the meeting to order at 7:30 p.m. with the playing of O'Canada.

APPROVAL OF MINUTES

MOVED BY Councillor Strickland, SECONDED BY Councillor Judge that the minutes of February 27, 2003 (public hearing and regular meeting) be approved as circulated.

BUSINESS ARISING

MEMBERSHIP - SUPPLY SERVICES BUILDING

The CAO reviewed the tabled motion regarding representation on the Committee developed to deliver the supply services building to Mariners Centre. MOVED BY Deputy Mayor Hood, SECONDED BY Councillor Boudreau that Council reaffirms the role of the Management Board which is to manage the site/facility and to make all decisions regarding buildings and make it clear that the Industrial Commission is a contractor with regard to the Supply Services Building

SOUTH WEST SHORE DEVELOPMENT AUTHORITY

The CAO reviewed the tabled motion regarding the South West Shore Seniors Residential Repairs Project.

Deputy Mayor Hood advised he had concerns regrading an overlap of jurisdiction, however as there were funds available for this project through this venue, he supported the project.

MOVED BY Councillor Dares, SECONDED BY Councillor Boudreau that a letter of support be forwarded to the South West Shore Development Authority, to support the proposed South West Shore Senior Residential Repairs Project.

CORRESPONDENCE FOR ACTION

FISHERIES & OCEANS RE: PROVINCE-WIDE SHORELINE SPEED RESTRICTION

Correspondence from the Fisheries & Oceans, Canadian Coast Guard Office of Boating Safety Maritimes, requesting input regarding the implementation of a Province-wide Shoreline Speed Restriction, on inland waters only, in the Provinces of New Brunswick, Nova Scotia, and Prince Edward Island, was considered.

MOVED BY Deputy Mayor Hood, SECONDED BY Councillor Dares that Council respond to the request from the Fisheries & Oceans, Canadian Coast Guard Office of Boating Safety Maritimes, requesting input regarding the implementation of a Province-wide Shoreline Speed Restriction, and advise that we as a municipal unit support their initiative.

UNSM - POLICE ACT

Correspondence from Ken Simpson, UNSM, regarding a new proposed Police Act, was considered.

MOVED BY Deputy Mayor Hood, SECONDED BY Councillor Strickland that a letter be forwarded to the UNSM advising that Council agrees with the issues they raised regarding the new proposed Police Act and supports the process being used to consult with municipalities.

CORRESPONDENCE FOR INFORMATION

MUNICIPALITY OF CUMBERLAND RE: TIPPING FEES

Deputy Mayor Hood commented on the tipping fees in the amount of $115 for the Municipality of the District of Cumberland. The CAO advised this amount was considerably more than current tipping fees for the Town of Yarmouth.

STANDING COMMITTEES

FINANCE COMMITTEE

In the absence of the Chair, the CAO advised there would be a preliminary Finance Committee meeting tentatively scheduled for Wednesday, March 26, 2003 at 7:00 p.m.

YARMOUTH WATER UTILITY

Deputy Mayor Hood advised he would be calling a preliminary meeting of the Lake George Watershed Protection Committee on Monday, March 24, 2003 at 7:00 p.m.

JOINT LEISURE SERVICES COMMITTEE

Councillor Dares advised the renovations to the Milo project had been stalled during the winter months, however there were monies left in the budget to continue the work in the spring. She also advised there was a carry over of capital monies.

OCCUPATIONAL HEALTH & SAFETY COMMITTEE

The CAO referred to the Occupational Health & Safety Policy as well as the duties of the Occupational Health & Safety Committee and Town employees, previously circulated.

MOVED BY Councillor Strickland, SECONDED BY Councillor Boudreau the Occupational Health & Safety Policy, be approved.

MOTION CARRIED

Deputy Mayor Hood raised concerns with protocol for complaints to the Department of Environment and Labour. The CAO agreed the protocol for anyone who wished to make a complaint should do so through the proper channels.

JOINT EMERGENCY MEASURES ORGANIZATION

Councillor Strickland advised the Joint Emergency Measures Organization is to be commended for their excellent work in achieving an excellent rating by the Province. He commented on the joint effort between the Town of Yarmouth and the Municipality of the District of Yarmouth and was pleased to have been a part of the project.

TOURIST ASSOCIATION

Councillor Strickland advised the Yarmouth County Tourist Association had been active in promoting and designing a new brochure. He also advised they had an additional page in the and Dreamers Guide which provided more exposure for this area and are fully supportive of the new regional director which will further help develop tourism for Yarmouth.

SOUTH WEST SHORE DEVELOPMENT AUTHORITY

Mayor Crosby advised the next meeting of the South West Shore Development Authority was scheduled for Wednesday, March 19, 2003

STAFF REPORTS

BLACK BULL

The CAO shared information previously circulated regarding Black Bull Resources was to keep Council informed of the project (Appendix A.)

FINANCIAL REPORT

In response to questions, the CAO provided a review of income from other sources from the Financial Report.

OLD BUSINESS

COMMITTEE APPOINTMENTS

Council discussed Committee appointments to the Industrial Commission. Concern was expressed that Roger King was appointed by the Town as well as by the Municipality of the District of Yarmouth and if Carl Doty should be the Town's appointee.

Councillor Boudreau expressed concern that the appointment of Carl Doty to the Industrial Commission may pose a conflict of interest.

After discussion,

MOVED BY Councillor Strickland, SECONDED BY Deputy Mayor Hood that Carl Doty be appointed to the Industrial Commission.

NEW BUSINESS

CANADIAN CHARITABLE ORGANIZATION BY-LAW (First Reading)

The CAO referred to the Canadian Charitable Organization By-law.

MOVED BY Councillor Dares, SECONDED BY Councillor Strickland that First Reading of the Canadian Charitable Organization By-Law, be approved.

CRISIS IN BADGER, NEWFOUNDLAND

Mayor Crosby advised Council and the citizens of Yarmouth there would be a benefit concert held at Zion Baptist Church on Saturday, March 29, 2003 for the citizens of Badger, Newfoundland. He encouraged everyone to support this relief fund raising effort.

APPROVAL OF INVOICES

MOVED BY Councillor Strickland, SECONDED BY Councillor Dares that invoices, as approved by the individual chairs, be authorized for payment
