A meeting of the Town Council of the Town of Yarmouth was held on Thursday, June 12, 2003.CALL TO ORDER
The Mayor called the meeting to order at 7:30 p.m. with the playing of O'Canada.

MOVED BY Councillor Dares, SECONDED BY Councillor Pink, that the minutes of the May 8th regular, committee and in-committee meetings of Council be approved as circulated.

DELEGATIONS
Alison Steward addressed Council on the Yarmouth/Cuba Educational Exchange Program.
She indicated that the program this year involves eighteen young adults, nine from Canada and nine from Cuba who would live with and learn from local host families, donate their skills and assist with community development and volunteer projects. The group would go to Cuba in November for a similar one-month experience.
She indicated there is still a need for host families and encouraged Councillors and the public to contact her for any additional information they may require.
Mayor Crosby conveyed his appreciation from Council and wished her good luck with the project.
GOUDEY PARK
Terry Deveau appeared before Council to request that the Goudey Park playground be repaired and reopened for the benefit of children in the area. She indicated that the residents in the surrounding area have indicated their willingness to monitor the activities and report any acts of vandalism to the proper authorities.
There was some discussion with reference to the request and the proximity of that playground to the playground operated by the Boys and Girls Club.
There was considerable discussion on the request and previous activity associated with the development and maintenance of that park. Councillors expressed concern regarding the cost of equipment, maintenance, security, lighting and related issues.
MOVED BY Councillor Dares, SECONDED BY Councillor Strickland, that staff be instructed to review and report on the initial cost of developing and maintaining the park as well as the anticipated cost to redevelop the playground to meet the community expectations.
MOVED BY Deputy Mayor Hood, SECONDED BY Councillor Strickland that the motion be amended to provide that the report be presented to and considered by Council at its next Finance Meeting scheduled for Wednesday, June 25th, 2003.
On the question, the AMENDMENT CARRIED; on the amended motion, AMENDED MOTION CARRIED.

ALPHA COURSE AN INVITATION TO THE NATION
Correspondence from Rev. Ulric Dawson requesting Council's approval to install lawn signs on a temporary basis was considered.
MOVED BY Councillor Dares, SECONDED BY Councillor Strickland, that Council authorize the installation of lawn signs in accordance with the proposal advanced by the Churches promoting the Alpha Course, An Invitation to the Nation, event for 30 days beginning August 20th, 2003.

Councillor Pink, Chair of the Finance Committee, indicated the next meeting of the Committee is schedule for June 25th at 7 p.m.
PUBLIC WORKS COMMITTEE
MOVED BY Councillor Dares, SECONDED BY Councillor Pink, that the Mayor and C.A.O. be authorized to award the tender for the storm water drainage proposal associated with the new correctional facility to the lowest bidder who meets the qualifications as recommended by the Town Engineer and/or the consultants, C.B.C.L. Limited.

PLANNING ADVISORY COMMITTEE
MOVED BY Councillor Judge, SECONDED BY Councillor Dares, that an amendment to the Town of Yarmouth's Subdivision By-law as outlined in the report entitled "Town of Yarmouth Subdivision By-law Draft Two Amendments March 5, 2003" including the following amendments to the proposed Subdivision By-law, be approved:
Insert a new definition of "water lateral" as Part 3.34 outlined below:
3.34 Water Lateral means that portion of the water line which is located on public property or on an easement, extending from a building service connection to a water distribution line.
Insert a new definition of "sewer lateral" at Part 3.25 (A) outlined below:
3.25(A) Sewer Lateral means that portion of the sewer line which is located on public property or on an easement, extending from a building service connection to a sewer collector line.
Insert a new definition of "building service connection" as Part 3.3(A) outlined below:
3.3(A) Building Service Connection means that portion of a sewer line which is located on private property and which connects the building drainage system or the building sanitary conveniences to the sewer lateral or that portion of the water line which connects a water meter to the water lateral.
Delete Part 15(2)(1) and substitute therefore the following:
(1) Connection to any water distribution line shall be carried out by the applicant under the supervision of the Yarmouth Water Utility.
Amend Part 16(2) by adding the words "sanitary sewer" prior to the word "laterals" in the first line.

MOVED BY Councillor Judge, SECONDED BY Councillor Strickland, that an amendment to the Municipal Planning Strategy, in particular Policy 2.4.1 and an amendment to the Land Use By-law, in particular Part 18.1 to include "personal service shops up to 500 square feet of gross commercial floor area" as a use permitted within the Local Commercial ( C-4) zone as outlined in Appendix "A" of the Planner's report and an amendment to the Land Use By-law, in particular Part 27(59), the definition of "personal service shop" by deleting the words "automatic laundry shops" and substituting therefore the word "laundromats" be approved.

MOVED BY Councillor Judge, SECONDED BY Councillor Strickland that an amendment to the Municipal Planning Strategy, in particular the Generalized Future Land Use Map by redesignating 9/11 Willow Street from Residential to Central Business District and concurrently an amendment to the Land Use By-law by inserting a new provision, Part 9.8, to enable medium density residential zoned lots located within the Central Business District to be changed to a use permitted by the Land Use By-law where the lot frontage or area or both are less than the requirements, provided all other requirements of the Land Use By-law are satisfied, and concurrently an amendment to the Zoning Map, Schedule "A" thereby rezoning 9/11 Willow Street from Low Density Residential ( R-1) to Medium Density Residential ( R-2) as outlined in the Planner's Report, and as a housekeeping amendment, amend the Municipal Planning Strategy, in particular the Generalized Future Land Use Map by redesignating a strip of land 12 feet by 103 ± feet, part of lands of 6 Thurston Street, from residential to Central Business District and concurrently an amendment to the Land Use By-law, in particular the Zoning Map, Schedule "A" thereby rezoning the subject area from Low Density Residential ( R-1) to Downtown Commercial ( C-1), be approved.

MOVED BY Councillor Judge, SECONDED BY Councillor Dares, that an amendment to the Municipal Planning Strategy, in particular Policy 2.2.5 by renumbering it to Policy 2.2.5(A) and inserting a new Policy, Policy 2.2.5(B), and concurrently an amendment to the Land Use By-law, in particular Part 19 by inserting a new Part 19.3 and 19.4 to enable existing residential uses within the Commercial Holding ( C-5) zone to be classified as permitted uses as outlined in Appendix "A" of the Planner's report, be approved.

MOVED BY Councillor Judge, SECONDED BY Councillor Dares, that an amendment to the Municipal Planning Strategy, in particular the Generalized Future Land Use Map by redesignating a portion of 221 Pleasant Street from Residential to General Commercial and concurrently an amendment to the Land Use By-law, in particular the Zoning Map, Schedule "A," thereby rezoning a portion of 221 Pleasant Street from Low Density Residential ( R-1) to Institutional ( I-1) and concurrently rezone a portion of 227 Pleasant Street from Commercial Holding ( C-5) to Institutional (I-1) as outlined in Appendix "A" of the Planner's Report, and concurrently an amendment to Policy 2.2.14 as outlined in Appendix "B" of the Planner's report, be approved.

YARMOUTH WATER UTILITY
Deputy Mayor Hood, Chair of the Yarmouth Water Utility, commented on a report that was circulated prior to the meeting in which he indicated the new plant should be operational about the 24th of this month.
OCCUPATIONAL HEALTH AND SAFETY COMMITTEE
Councillor Boudreau reported on the recent meeting of the Occupational Health and Safety Committee. He indicated the Committee was advised that the compliance order has been implemented and employees would be receiving SCBA training as required. OTHER COMMITTEES
YARMOUTH COUNTY INDUSTRIAL COMMISSION
Mayor Crosby responded to various questions relative to the progress on the storage building presently under construction at the Mariners Centre.
